Affiliation to the
CTC for Cycling Clubs
Dear Secretary, Thank you for your enquiry
regarding affiliation to the CTC for your Club.
Club Affiliation.
CTC Club Affiliation is for a fixed
year, starting on October 1st. The full year fee for 2003-2004 is just £30.50. Clubs
joining between April and September will be able to affiliate to the CTC at a
reduced rate of £18.75.
Club Insurance.
Our club policies, including Public
Liability (3rd Party), Organisers Liability, and Clubroom Effects and
Trophies
Insurance also have an October 1st renewal. As with
membership, insurance is offered on a fixed year basis.
Premium will be charged on a pro-rata
premium through to 30 September EXCEPT for third party insurance
premiums
(see below).
Affiliated
Members Public Liability Insurance (3rd Party)
Third Party Public Liability insurance is
available to your members, again running for a fixed year to 30 September. If
your members wish to have CTC Public Liability cover, the cost is £10 for applications
made between 1st October and 30th March, or £7 for
applications made on or after 1st April, both
running to 30 September.

CYCLISTS TOURING CLUB - THIRD PARTY
INSURANCE
Any cyclist involved in an
accident which causes injury or damage to another person or property may have a
third party claim made against him. Every member of the CTC normally resident
In Great Britain, Northern Ireland, Eire, the Isle or Man, or the Channel
Islands, is insured against such a claim up to £5,000,000 in the World except
in the USA and Canada.
This protection is
valid only so long as the insured person remains a fully paid-up member of the
CTC or is an insured member of an Affiliated Club.
No matter how careful a
cyclist may be, whenever he goes for a ride he takes the chance that he may be
involved in an accident or which the Law, as interpreted by a judge or jury,
will hold him to blame. Third party claims may arise from indirect causes. For
instance, a member of the CTC was actually held responsible for the damage that
ensued when a motor car crashed into a shop window. The cycle itself did no
damage but it was held that the presence of the cycle had been the cause of the
cars collision with the shop.
In addition to covering the
member while using his cycle for private and professional purposes, the
insurance also includes business cycling. This means all forms of business
riding, except those in which a member is specifically employed as a cyclist
e.g. as a cyclist-messenger or a carrier cyclist. In such cases liability
should be borne by the employer and there should be no need for Individual
insurance by the employee.
It should be noted that the
scheme also covers time-trials and record breaking (except that the Insurers
are not liable for damage or injury to one competitor caused by another
competitor).
The policy is issued by
Norwich Union Insurance, who undertake subject to the prescribed conditions and
limitations, to indemnify the member against all sums which he or she shall be
legally liable to pay as compensation for:
a) Accidental
bodily injury to any person (other than a person in the member’s service or
being conveyed by the member or riding with the member on the same cycle).
b) Accidental
damage to property (other than property belonging to any of the member’s family
or actually the members own or held in trust by the member or being conveyed on
the said cycle) where such injury or damage is caused while the member is
riding or wheeling a cycle (which word “cycle” shall be defined as meaning any
bicycle or tricycle or tandem or triplet not driven by mechanical power).
Provided always that the liability of all claims for compensation payable to
any claimant or any number of claimants in respect of or arising out of any one
accident (which word “accident” shall be held to include a series of accidents
occurring in connection with or arising out of one event) is limited to
£5,000,000. The insurers will in addition be responsible for costs and expenses
recovered from the member by any claimant in connection with any such accident
and for costs incurred with the written consent of the Insurers. Further, the
Insurers will pay the solicitor’s fee for representation at any Coroner’s
Inquest or fatal inquiry or for defending in any police court any proceedings
that may be taken against the member in respect of the riding or wheeling of a
cycle at the time of an accident which may be the subject of indemnity under
this policy, provided that authority for such legal assistance has been
obtained from the CTC Headquarters office. Provided always that no liability
shall attach to the Insurers while a cycle is let out or used for hire or is
being used other than for private or professional purposes (it being understood
that cycles used in connection with trade are specifically excluded from the
indemnity granted by this policy) but liability shall attach to the Insurers
while a cycle is being used for riding to and from business, for occasional
business trips, for ambulance purposes and in. time trials. Provided always
that no liability shall attach to the Insurers in respect of injury or damage
caused to any competitor by any other competitor while engaged in racing,
pace-making or time trials. An excess of £250 applies to any claim made under
this section.
OPTION TO INCLUDE INVITEES
In order to protect fully
members of your Club from the negligence of an invitee that might arise, the
CTC can now offer limited third party insurance to invitees up to a maximum of
five per ride. The third party insurance protects invitees against claims by
CTC members on the ride but does not give protection against claims by fellow
invitees or members of the public. The additional premium per annum is £15
irrespective of the number of rides. The cover for invitees commences at the
start of a ride and concludes at the end of that ride. In the event of any
incident during the ride giving rise to a claim against an invitee under this
provision, full details of the parties concerned should be noted.
CONDITIONS
1. In
the event of any accident, the CTC Accident Line should be contacted as soon as
practicable on 0870 873 0062.
2. Notice
shall be given in writing to the CTC as soon as reasonably possible, after the
occurrence of any accident. Every letter, claim writ, summons or process shall
be notified or forwarded to the CTC immediately on receipt. Notice shall also
be given in writing to the OTC immediately the member shall have knowledge from
whatever source of any impending prosecution in connection with any accident
for which there may be liability under this policy.
3. No
disclosure of insurance, admission of liability, offer, promise or payment
shall be made to third parties by the member, without the written consent of
the Insurers, who shall be entitled, if they so desire, to take over and
conduct in the name of the member the defence or settlement of any claim, or to
prosecute in his name for their own benefit any claim for indemnity or damages
or otherwise against any third party, and shall have full discretion in the
conduct of any proceedings or in the settlement of any claim, and the member
shall give all such information and assistance as the Insurers may require. The
Insurers may, prior to or at any stage of such proceedings pay to the member
the full amount payable under this policy in respect of any claim or claims,
and shall thereupon be relieved from all further liability in respect of such
claim or claims and shall not be responsible for any damage alleged to have
been sustained by the member in consequence of any action or omission of the
Insurers in connection which such claim or claims or proceedings.
If at any time any claim is
made under this policy there is any other existing insurance covering the same
risk, whether affected by the member or any other person, the Insurers shall
not be liable to pay or contribute more than their rateable proportion of the
liability in respect of such claims, provided always that such rateable
proportion shall not exceed the sum of £5,000,000.
NOTE: The insurance year runs for the same period as
affiliation to CTC. Any insurance taken out during that year becomes renewable
on your affiliation renewal date.
PUBLIC
LIABILITY INSURANCE: “ORGANISERS’ LIABILITY”
In a world which is
becoming increasingly insurance conscious, and where possible claims can now
arise out of any situation for which participants may hold the organisers of an
activity responsible in law, we believe it is extremely important for all
cycling club officials to consider the implications of their liability in
events which they are organising, and to seek indemnity through insurance
against claims which might be made against either the club or the officials
themselves.
Accordingly, the CTC has
now arranged to provide “Organisers’ Liability” cover for its affiliated clubs,
where this is required, through a master policy, arranged on a schedule basis,
which indemnities the Affiliated Club and its officials against any claims of
liability made by participants in the Affiliated Club’s organised activities,
on payment of an annual premium.
EXTENT OF COVER AND EXCLUSIONS
The cover offered extends
to all cycling events (sponsored rides, tourist trials, club runs, fun rides,
invitation rides. reliability trials, etc) that an Affiliated Club may organise
during the year, but events involving time trialing and speed racing (road
racing) are specifically excluded.
COVER APPLIES TO THE BRITISH ISLES ONLY
The limit of indemnity will
be £5,000,000 but there is a £250 excess on all property damage claims -that
is, the organising club must contribute the first £250 of any claim involving
damage to property. There is no excess payable for claims involving
personal injury.
PREMIUM
A basic premium of £30.50
per Affiliated Club is payable regardless of the size of your membership, plus
a fee of 40p per head for all your members, whether or not they are
individual members of the CTC or BCF. We must stress this point since cover
will only be valid if a premium is paid for your total membership, as it stands
at the date your premium is paid. An increase in your membership during the
ensuing twelve months will not invalidate any claim you need to make.
Please note that it is a
condition of insurance that you notify the CTC of any single event or
activity falling within the scope of this policy which involves more than two
hundred participants.
NOTE:
The insurance year runs for the same period as your affiliation to CTC. Any
insurance taken out during that year still becomes renewable on your
affiliation renewal date. See your affiliation form for details of the
transition to the fixed affiliation and insurance period of 1 October - 30 September annually.
